A BILL to extend the time for the City Council of Fairmont, Marion County, West Virginia, to meet as a levying body for the purpose of presenting to the voters of the city an election for a municipal excess levy for purposes of providing funding for the repair and paving of streets and roadways of the City of Fairmont from March 7-28 and the third Tuesday in April until June 8, 2010.

Be it enacted by the Legislature of West Virginia:
THE CITY COUNCIL OF THE CITY OF FAIRMONT MEETING AS A LEVYING BODY EXTENDED.

§1. Extending time for the City Council of Fairmont to meet as a levying body for an election authorizing a municipal excess levy to provide funding for the repair and paving of the streets and roadways.

Notwithstanding the provision of article eight, chapter eleven of the Code of West Virginia, 1931 as amended, the City Council for the City of Fairmont, Marion County, West Virginia, is hereby authorized to extend the time for its meeting as a levying body, for the purpose of submitting to the voters of the city of Fairmont the question of authorizing a municipal excess levy for providing funding for the repair and paving of streets and roadways of the city of Fairmont, the levying date shall be set between March 7 - 28 and the third Tuesday in April until June 8, 2010.
